Contractul de partaj

Partajul se poate realiza la notariat, prin contract de partaj, atunci când coproprietarii se înţeleg asupra cotei-părţi ce va reveni fiecăruia. După realizarea actului de partaj, fiecare parte devine proprietară exclusivă asupra unei părţi determinate sau asupra unui bun dintre cele care au format obiectul coproprietăţii.

Contractul de partaj notarial se poate realiza în câteva zile, spre deosebire de partajul în instanță, și cuprinde următoarele etape:

1. Părțile vin la notariat pentru a depune actele necesare (vedeți rubrica de mai jos) și completează cererea de eliberare a extrasului de carte funciară pentru autentificare;

2. În 2-3 zile, după ce biroul notarial obține extrasul de carte funciară de la OCPI, pățrile pot veni la notariat pentru semnarea contractului.

3. Notarul public înscrie contractul de partaj în cartea funciară în aceeași zi sau în ziua următoare autentificării contractului.

Acte necesare partaj bun imobil

  • acte de identitate părţi;
  • acte de proprietate asupra imobilului ce face obiectul partajului (după caz: contract vânzare-cumpărare, contract de donaţie, proces-verbal de predare-primire, act vânzare-cumpărare autentificat, sentinţă/decizie civilă definitivă şi irevocabilă, titlu de proprietate, certificat de moştenitor etc.);
  • certificate fiscale pe numele fiecăruia dintre coproprietari, eliberate de Administraţia Financiară competentă, din care să rezulte că aceștia sunt la zi cu plăţile către Stat. Administraţia Financiară competentă este cea la care se plăteşte impozitul anual pentru imobilul respectiv. Certificatul fiscal este valabil numai până la sfârşitul lunii în curs.
  • documentaţia cadastrală a bunului imobil (fişa bunului imobil şi planul de amplasament, respectiv planul releveu), întocmită de un expert cadastral autorizat;
  • extrasul de carte funciară se obţine prin intermediul biroului notarial şi este valabil 10 zile lucrătoare de la data înregistrării cererii;
  • în cazul apartamentelor, adeverinţa eliberată de asociaţia de proprietari sau locatari care sa arate că proprietarii sunt la zi cu datoriile faţă de aceasta (întreţinere, cheltuieli, reparaţii, cheltuieli comune etc.).
  • în cazul terenurilor, certificat de urbanism;

Partajarea bunurilor în mod amiabil, prin contract notarial de partaj este mult mai avantajoasă datorită costurilor mai mici și a duratei procedurii față de partajul în instanță.
