Conform art.118 alin.(1) din Ordonanța de urgenţă a Guvernului nr 195/ 12 decembrie 2002 privind circulaţia pe drumurile publice, împotriva procesului-verbal de constatare şi sancţionare a contravenţiei se poate depune plângere, în termen de 15 zile de la comunicare, la judecătoria în a cărei rază de competență a fost constatată fapta.

Plângerea contravenţională se depune la judecătoria în a cărei rază de competență a fost constatată fapta. În cazul introducerii plângerii la o altă judecătorie, plângerea nu va fi respinsă ci va fi înaintată pe cale administrativă instanţei competente.

Plângerea suspendă executarea amenzii şi a sancţiunii contravenţionale complementare dispuse prin procesul-verbal de constatare şi sancţionare a contravenţiei de la data înregistrării la judecătorie. Așasar, odată cu depunerea plângerii contravenționale trebuie să depuneți și o cerere pentru eliberarea unui certificat de grefă întrucât acest înscris reprezintă dovada înregistrării plângerii pe rolul instanţei.

Atenție: Chiar dacă aveți de gând să formulați plângere împotriva procesului-verbal de contravenție, recomandat este să achitați cuantumul amenzii înainte, pentru a beneficia de reducerea de 50%, urmând ca în cuprinsul plângerii să specificați faptul că doriți restituirea sumei plătite. Conform art.28 alin.(1) din Ordonanța Guvernului nr. 2/2001 privind regimul juridic al contravenţiilor „ Contravenientul poate achita, în termen de cel mult 15 zile de la data înmânării sau comunicării procesului-verbal, jumătate din minimul amenzii prevăzute de actul normativ, agentul constatator făcând menţiune despre această posibilitate în procesul-verbal.”

Descriere

Sancţiunile contravenţionale sunt principale şi complementare.

Sancțiuni contravenționale principale, conform art. 95 din Ordonanța de urgenţă a Guvernului nr 195/ 12 decembrie 2002 privind circulaţia pe drumurile publice, sunt următoarele:

1. avertismentul (constă în atenţionarea verbală sau scrisă a contravenientului, însoţită de recomandarea de a respecta dispoziţiile legale);

2. amenda.

Sancțiuni contravenționale complementare (se aplică prin acelaşi proces-verbal prin care se aplică şi sancţiunea principală), conform art. 96 din Ordonanța de urgenţă a Guvernului nr 195/ 12 decembrie 2002 privind circulaţia pe drumurile publice, sunt următoarele:

1. aplicarea punctelor de penalizare;

2. suspendarea exercitării dreptului de a conduce, pe timp limitat;

3. confiscarea bunurilor destinate săvârşirii contravenţiilor prevăzute în prezenta ordonanţă de urgenţă ori folosite în acest scop (se dispune de către poliţia rutieră prin procesul-verbal de constatare a contravenţiei, odată cu aplicarea sancţiunii amenzii);

4. imobilizarea vehiculului (se dispune de către poliţistul rutier și constă în scoaterea vehiculului în afara părţii carosabile, pe acostament sau cât mai aproape de marginea drumului, şi punerea lui în imposibilitate de mişcare prin folosirea unor dispozitive tehnice sau a altor mijloace de blocare);

5. radierea din oficiu a înmatriculării sau înregistrării vehiculului, în cazul în care acesta este declarat, potrivit legii, prin dispoziţie a autorităţii administraţiei publice locale, fără stăpân sau abandonat.
