Vânzarea unui bun imobil este contractul prin care o persoană transmite alteia proprietatea unui teren, apartament, casă etc., în schimbul unui preț.

În cadrul actului se vor putea face şi alte menţiuni referitoare la:

  • certificatul de performanţă energetică a clădirii prevăzut de Legea nr. 372/2005:
  • lecturarea actului de către părţi şi acordul acesora cu privire la conţinutul său care trebuie să reprezintă voinţa lor neviciată;
  • efectuarea lucrărilor de publicitate imobiliară de către notarul public conform art. 54 alin. 1 din Legea nr. 7/1996 a cadastrului;
  • includerea unui pact comisoriu rang IV;
  • reţinere privilegiul vânzătorului;
  • în cazul vânzării prin mandatar-împuternicit, se va preciza că mandatul dat în vederea încheierii contractului de vânzare-cumpărare nu este revocat şi ca nu a intervenit o altă cauză de încetare a acestuia;
  • predarea bunului;
  • numărul de exemplare în care a fost redactat actul.

Contract de vânzare-cumpărare imobil

Vânzarea unui bun imobil este contractul prin care o persoană transmite alteia proprietatea unui teren, apartament, casă etc., în schimbul unui preț.

În Noul Cod Civil român, contractul de vânzare-cumpărare este definit şi reglementat la articolele 1650-1762.

Vânzătorul va declara, pe propria răspundere:

  • că nu a ipotecat imobilul şi nici nu l-a înstrăinat prin act autentic sau sub semnatură privată, acesta nefiind în litigiu pe rolul vreunei instanţe judecătoreşti şi nu face obiectul unei cereri de retrocedare în baza Legii nr.10/2001. De asemenea, vânzătorul va declara că nu a instituit niciun alt drept asupra imobilului, ca de exemplu orice servitute, drept de uzufruct, drept de posesie, privilegiu, drept de folosinţă, închiriere, comodat, drept de preempţiune, restricţie de înstrăinare sau orice altă sarcină sau restricţie asemănătoare;
  • că şi-a achitat a zi impozitele locale şi datoriile către asociaţia de proprietari;
  • că suportă impozitul prevăzut de art.77^1 Cod fiscal (dacă este cazul şi părţile nu au stabilit altfel);
  • consimţământul său la intabularea dreptului de proprietatepe pe numele cumpărătorului;
  • că îl garantează pe cumpărător împotriva oricăror evicţiuni sau vicii ascunse.

Cumpărătoul va declara, pe propria răspundere:

  • starea sa civilă;
  • că are cunoştinţă de situaţia juridică şi faptică a bunului vândut;
  • că se obligă să înscrie bunul cumpărat la organele fiscale;
  • că suportă cheltuielile ocazionate de autentificarea actului şi intabularea dreptului în cartea funciară a imobilului achiziţionat.

În cadrul actului se vor putea face şi alte menţiuni referitoare la:

  • certificatul de performanţă energetică a clădirii prevăzut de Legea nr. 372/2005:
